Title: Buying Land in Uganda? Don’t Lose Your Money & Your Peace of Mind

Land is a precious asset in Uganda, but the process of acquiring it can be a minefield for the unwary. From fraudulent land titles to boundary disputes with “original owners,” many Ugandans have learned the hard way.

Here is a simple 4-step checklist before you pay a single shilling:

  1. Conduct a Physical Search: Visit the land. Are there squatters? Is there a visible boundary? Talk to the neighbors.

  2. Do a Registry Search: Go to the Ministry of Lands or the local Zonal Office. A search reveals if the title is genuine and if there are any caveats, mortgages, or encumbrances.

  3. Verify the Vendor’s Identity: Ensure the person selling the land is the actual person named on the certificate of title.

  4. Sign a Binding Sale Agreement: Verbal promises don’t hold up in court. Have a lawyer draft or review the sale agreement before exchanging money.

Pro Tip: Avoid “Kibanja” (customary tenancy) purchases unless you fully understand your rights as a tenant. These disputes are the most frequent in the Magistrates Courts.
